This morning on ABC, George Stephanopoulos asked Vice President Cheney if he would testify before Congress if he was subpoenaed. Cheney said "probably not in the sense at that vice president and president and constitutional officers don't appear before the Congress." He raises an interesting issue. During the Nixon Administration, Nixon's tapes were subpoenaed. This went all the way to the Supreme Court who upheld the subpoena. While there is a separation of powers issue, here, I wonder whether a subpoena of a sitting Vice President would be upheld.
