The Bush administration increasingly emphasized partisan political ties over expertise in recent years in selecting the judges who decide the fate of hundreds of thousands of immigrants, despite laws that preclude such considerations, according to an analysis by The Washington Post.

"the Justice Department began to jettison the civil service process that traditionally guided the selections in favor of political considerations".

Every other position has been filled by unqualified incompetents why not immigration?

Do you think it was to give asylum to those who might vote Republican?

"Immigration Judges Often Picked Based On GOP Ties"

This is an odd heading for a (non) story. Obviously meant to influence those who are "naive"

A more accurate heading would read

"Politically Appointed Judges are often picked base on politics, theirs and those doing the appointing."

It's been this way for a long time.

Recess appointment of a Judge, it doesn't get any more political than that.

President George Washington appointed South Carolina judge John Rutledge as Chief Justice of the United States during a congressional recess in 1795.

On August 11, 1902, President Theodore Roosevelt named Oliver Wendell Holmes Jr. to the United States Supreme Court through a recess appointment.

New Jersey judge William J. Brennan was appointed to the United States Supreme Court by President Dwight D. Eisenhower in 1956 through a recess appointment

50% competent 50% incompetent, that's pretty good for government workers.

From the article: "All the judges appointed during this period who arrived with experience in immigration law were prosecutors or held other immigration enforcement jobs."

So the judges selected were either neo-cons or had ENFORCEMENT experience. This whole thing is puzzling, given that the President is so in favor of immigration reform (amnesty) he is at the same time setting up the judiciary to be ANTI illegal immigrant. What is really going on?

Of course, Radiofreeeuropa has probably hit the nail on the head by suggesting that the level of incompetency must be maintained throughout the system.

Ya need to read the whole article, pg 2

Since Sept. 11, 2001, the Bush administration has said it is employing the nation's 54 immigration courts, with 226 judges, as a central tool of its anti-terrorism policies, using them to deport hundreds of noncitizens who were detained as terrorism suspects but were not charged with crimes

Makes sense to me. Good reason to change a course

The next president is going to have to fully clean house at Justice or we will continue on with a rankly partisan agenda of justice for all who are GOP contributors instead of the blind justice which it it supposed to administer.

"instead of the blind justice which it it supposed to administer"

After paragraph 12 do we get an insight as to what this story is all about.

A 2005 lawsuit by the government's chief immigration lawyer in El Paso for 22 years. Guadalupe Gonzales -- no relation to the attorney general -- alleged she was denied a judgeship twice in favor of less-qualified white men. Gonzales V Gonzales Gota love it, Gonzales is suing Gonzales for discrimination of people named Gonzales.

And now this farce goes to the next level. A Clinton politically appointed Judge, Emmet G. Sullivan, will rule on this case.

In September, Judge Emmet G. Sullivan (Who was On June 16, 1994, appointed by President William Clinton)

of the U.S. District Court for the District of Columbia ruled against the department, finding that Gonzales "had identified a particular policy that has a discriminatory effect on a particular group."

those elections were STOLEN. This administration is criminal from its inception, though with war crimes they've initiated in Iraq, Afghanistan, and Cuba, they are quadruple-charged. All of them need to go to jail for LIFE

I just love the Bush bashers. Their theme is always the same.

The facts is, every President is allowed to appoint whomever POTUS thinks he can get past the Senate. Clinton appointed some real knuckle draggers who ended up being a total embarrassment. I forget who the Black woman MD Clinton named as Surgeon General. She was on the nightly 6:30 PM news talking about masturbation and how good it is for you. Masturbation and other actions using the Presidential penis were popular with Clinton, but seemed to evoke strong emotions with everyone else. His Agricultural Secretary was headed for indictment when his plane crashed.( wonder how that happened?)

I could name more, but the point is, the left forgets the process when the knuckle dragging appointee is a democrat.

...Dubya is the only president to have a presidential directive to require a political oversight committee over every government agency. Gonzo's ills are a result of it. Political appointees in the Justice Department got the torture memo Dubya wanted, the loss of habeas corpus and the use of hearsay at gitmo. The rewriting of science reports and neglect of global warming for over 6 years is part of it. He has politicized everything to try and make himself look better. Using security as a rational to classify the Cheney Energy meeting minutes with the likes of Ken Lay. No president ever tried to hid so much with the unitary executive he espouses and the lack of honest cooperation with the New Congress. If you can't see this you have you blinders on!

Actually it only roused strong emotions in the Republican fundies who really had no clue what she was talking about. Coould be one of the reasons the world treats REPUBLICANS as laughing stocks.

"FLASH...........we've just learned that it is common pratice for an administration to appoint persons of their own political persuasion to positions usually filled by political appointees. Apparantly this has happened before, but until now, it just wasn't news worthy"

Of course, the real problem with Bushies, and we see it over and over, it their putting political considerations AHEAD of competence.

All you Bushies can point to Clinton and moan and groan all day long, but the fact is that Clinton appointed people who were qualified to do the job, and Clinton had a very competent administration that accomplished a lot.

Bush, on the other hand...WORST PRESIDENT EVER!!!!!!!!!!

Like good ol Janet Reno, kill 'em all in Waco, and Madeline Albright, the first female Secreatry of state, who along with Carter and Clinton gave the nuke plants to N korea...that worked out great....what other accomplishments of Clinton were you referring to, I for one would really like to hear them. Not how great the economy was, coz economics ..oo1 will tell you it takes about 6 years for economic policy to come to fruition, so don't give accolades to clinton for Reaganomics....but you may give Clinton the "credit" for the economy being in a small recession when Bush took office tho. Maybe you meant all of the military cuts that clinton did while in office, to help make a pretty budget...wonder if those cuts mite be why our soldiers had inferior vests and so forth in Iraq?

You can't be this dumb. These appointments and selections are ALWAYS politically motivated. ALWAYS! The democrats did it, the republicans are doing it, and when the democrats win the POTUS again, the democrats will do it again. They function the same, folks. That is just a part of the sytem. The dems are just as bad as the repub. and vise versa, have you forgotten the terrible Clinton administration!

From the article: "Still, the injection of political considerations into the selection of immigration judges has attracted congressional attention in the wake of controversy over the Bush administration's dismissal last year of nine U.S. attorneys."

If the authors were interested in a truly unbiased assessment of judicial appointments, they would have performed their analysis on judicial appointments during the course of our nation's history. Anyone believing that it is only the current administration that has considered political ideology for judicial appointments is deluded.

"Those two officials, D. Kyle Sampson and Monica M. Goodling, have said they were told the practice was legal. But Justice spokesman Dean Boyd said that immigration judges are considered civil service employees who may not be chosen based on political factors, unlike judges in federal criminal courts."

Yeah, another convenient thing Gonzo forgot about while testifying to Congress.
