The only bright spot is that abandoning the Constitution cuts both ways - if Bush and Dickless Cheney say the Constitution doesn't apply to them, why should we be restrained by the rule of law in order to deal with them?

Somebody should tell that dimwit Harkin to get his buddies together and call waterboarding torture! But no, he's too much of a dimwit to do that. Other senators KNOW that waterboarding is an effective tool to get information. It has worked on Khalid Sheik Mohammed.
Senator Harkin should keep his mouth shut lest he show the world how stupid he is and how much he hates his own country.

You're absolutely correct, and many of the remarks you read are from others "who just don't get it". The rights of habious corpus do NOT apply to enemy combatants and/or non citizens. Let's say you were on vacation in France, I'd expect that I'd have to abide by their laws. POW's are entitled to protection under the Geneva convention. But, and this is a big BUT, the entire world body recognizes "troops" wearing the uniform of a nation at war are to be protected, not terrorists.
This leads up to the final point, "there is a general theme here", eg. Ever since the war started, objectors have wanted to know the exit strategy and have a time line in place. The enemy would merely sit and wait and we'd lose, as this is not a conventional war. Harkin, if he gets his way would reveal intelligence techniques to the enemy. What prisoner would "spill the beans" then? The enemy would be trained to resist, knowing our limits, how stupid.

Obaku, are you talking about the claims of executive privilege that's never been fully defined under the Constitution? Congress needs to address that in order for the Courts to deal with that. This was a problem under the last 12-15 presidents going back to FDR when they wanted to ask him about Dec-7th. Now before you think I'm bashing a lefty, I'm not, I'm stating a problem we've had for a long time.
So going back, to congress, instead of the non-binding resolutions and attempts to cut our funding, perhaps clearly defining the executive privilege in the Constitution would help things out. Currently Bush, Clinton, Bush, Reagan, Carter, Nixon, Johnson, Roosevelt and a few others hid behind it. It's time to set up guide lines and follow them. Regardless which party controls the White House.

You're on to something, but under the Constitution, congress can not define executive privilege. That would make them the preeminent branch. It is the Supreme Court's duty to define executive privilege. (and maybe they should). I'm no constitutional scholar, but I feel there's case history out there that shows this to have already happened and Harkin is just shooting of his mouth.
